Outline of Research at the Start

本研究は、フランスが2016年に導入した買春処罰を含む性売買関連法制を参考に、日本の性売買規制のあり方を探究するものである。
性売買に対する規制は、近代的なリベラリズムとの摩擦を孕む。しかし、性売買が女性の尊厳を毀損するものでありその根絶が国際的潮流である以上、日本でも、個人の自由や自律との整合性を図りつつ、その根絶のための実効的な法制度を構築しなければならない。これまでの憲法学の研究では、具体的な法制度を検討する研究が不足しているため、本研究では、大規模な法改正を行ったフランスにおける議論を分析し、日本における制度設計のための課題要素を析出した上で、性売買規制についての政策的提案を行う。
