Outline of Research at the Start

法律や条例によって一定の範囲の者に「参加権」が認められている場合であっても、その権利に対する法的保護が不十分であれば、結果として、行政実務において参加権の存在は軽視されかねない。本研究は、参加権の裁判的保護について、主にドイツとの比較法研究を行うことを通じて、参加権の法的保障の可能性をより拡大するという見地から、新たな解釈論を提示し、また、それを基礎付けるための理論を構築することを目指すものである。
