Outline of Research at the Start

本研究は、政府が自国民に対し重大かつ組織的な国際人権法・人道法の違反を行なっている場合に、当該政府は人道的介入を受け入れる義務があるか、外国（又は国際機関）は人道的介入を行う権利（又は義務）があるのかにつき、武力行使禁止原則の2元的理解に基づいて検討するものである。
武力行使禁止原則の2元的理解とは、同原則を国家対国家的視座と人間的視座の両者から理解するという独自の理論枠組であり、同意に基づく武力行使を研究する中で提唱したものである。本研究は、人道的介入の検討において同意に基づく武力行使を比較対象とすることで、両者を武力行使禁止原則の2元的理解のもとで整合的・統一的に把握することを目指す。
