Outline of Research at the Start	本研究は、「気候危機」と呼ばれる自然科学的現象が刑法上の緊急避難論にいかなるパラダイム転換をもたらすかを論定することにより、「気候危機」時代における緊急避難論の在り方を示すものである。そのために、まず、そもそも「気候」という法益を守るために緊急避難を行うことが原理的に可能であるのかについての理論的検討を行う。しかる後、「気候」を守るための緊急避難が原理的に可能であるとした場合、特定個人による「気候保護」に向けた活動が「気候」という法益を守るために適切な避難行為たりうるかという問いに取り組む。なお、以上の検討にあたって、議論の蓄積があるドイツ刑法学の知見を参照する。
