Outline of Research at the Start

民事訴訟において、確定判決の効力は当事者だけでなく承継人にも及ぶとされているが、この規律は裁判を受ける権利の保障と判決の実効性確保の調整を要する重要な問題をはらんでいる。特に近年、所有権に基づく返還請求事案での承継人への効力拡張について論争が起きている。本研究は、この問題について、実体法と訴訟法の観点を基礎に据え、ドイツ法との比較研究を行う。関連領域を含めた横断的検討を通じて、議論の基礎となる理論構造を明らかにすることを目指す。
