Outline of Research at the Start	民法では、当事者間で契約内容を自由に決定しうる（契約自由の原則）。しかし、一定の場面では、契約当事者を不平等に扱ってはならない（平等原則）。この２つの原則をどのように調整すればよいのか。また一方当事者が平等原則に違反した場合に、被害者を救済するためにどのような効果を生じさせるべきか。本研究は、ドイツ法の議論を整理・考察することによって、日本法における契約自由の原則と平等原則との調整のあり方、平等原則に違反した場合の効果について新たな視座を提供することを試みる。
