Outline of Research at the Start

本研究は、医療／平時及び緊急時のパブリック・ヘルスにおける無過失補償制度について、制度枠組みや内容において異なる特徴を持つ各国（アメリカ、イギリス、ニュー・ジーランド及び日本）法制度を検討し、不法行為法理論及び社会保障法理論との関係において各国制度の無過失補償制度が拠ってたつ理論的基盤を比較により明らかにするとともに、各国においてそれぞれの理論基盤を反映した現状の制度が運用面において抱える問題と可能性につき検討し明らかにしようとするものである。
