Outline of Research at the Start	本研究は、「研究の目的」欄に詳述の通り、国際取引(契約)法と国内契約法の調和による取引円滑化を目指すものであり、特に「契約の有効性」に関する法に焦点をあてるものである。この際、国内法については、(特に改正後錯誤法につき)本邦の理論も従前の整理に附合せず理論的明らかでないほか、国際取引の場面に於いても、従来の国際取引条約やモデルローに於いては射程や通用力の観点から、この法領域について十分な法的秩序と理論的整合性が保たれているものとは云えない。そこで、本研究はこれらの理論的定立にあたり、コモンローや大陸法の理論の融和的検討のために混合法域の理論を参照することで、従来の理論的不協和の解消を試みたい。
