Research Abstract |
The following problems have been investigated. Concerning the Early Middle Ages: <i> ) the role of the Roman law and the canon law for the birth of the written legal sources in the early medieval ages, <ii> ) the meaning of the roman and canon law in the criminal law of the early medieval ages, <iii> ) the influences of the tradition of the classical antiquity and the church upon the images and organization of the medieval society. Concerning the High Middle Ages: <i> ) the logical structure of the "Sachsenspiegel", <ii> ) the meaning of the ideas of the roman Empire for the continuity and objectivity of the German Kingdom, <iii> ) the antique and ecclesiastical backgrounds of the ideas which played a significant role for the birth of the city communes. Concerning the Late Middle Ages: <i> ) the process of the "Verwissenschaftlichung" of the law through the reception of the canon law proceedings, <ii> ) the meaning of the science of the roman and canon law for the establishment of the "Landesherrschaft" and the liberties of the estates. Concerning the modern times: the birth and meaning of the "Historische Rechtsschule".
