| Research Abstract |
The object of this research is evidential study on the duty of water reserving land and relation of the right of land. Water reserving land is one of the flood control, and reserves transitionaly water when the flood breaks out. The relation of the right of water reserving land is acqusition of the right of ownership, establishment of the easement, use by advance payment of damage compensation and others. Accoding to materials of the Ministry of Construction, water reserving land is Okubo, Ichinoseki, Minamiyachi, Kabukurinuma, Shinainuma, Watarase, Sugao, Inatoi, Tanaka, Odai, Saikawa, Ueno, Okahata, Magoshi, the green land of river improvement, multipurpose water reserving land are Okitategawa, Sakuragawa, Shibakawa, Ayasegawa, Tomoegawa, Shinkawa, Neyagawa, Onchigawa, Tsuboigawa. In a standpoint of evidential reseach, I inspected all water reserving land, the green land of river improvement and multipurpose water reserving land except Okitategawa and Tsuboigawa, and examinated the relation of rights. Acqusition of the right of ownership is Watarase which was improved in connection with an event of Ashio mine pollution, Okahata and Magoshi which need the excavation, the green land of river improvement, multipurpdse water reserving land which improve with other purpose. Establishment of easement is Kabukurinuma. Okubo,Ichinoseki and Ueno are this plan.Use by advance payment of damage compensation is Minamiyachi and Shinainuma.
