| Research Abstract |
本研究は複雑な事件における供述の変遷を分かりやすく提示することが主要な目的である。わかりにくさの要因としては、自白変遷や複数人の供述対立、があげられる。こうしたわかりにくい供述変遷を、整理するための三次元可視化システムを作成した。ある公職選挙法違反事件に関する記述を用いて概念マップを作り、自白供述がなされた時間を層として扱うことで、三次元キューブを作成するのである。今回取り扱う事件は少なくとも6名が(結果的に)虚偽の自白を行ったのだが、いつ、dこで、どのような虚偽を行ったのかを可視化するためには、適切な概念マップが必要となる。この事件については複数の単行本が出されているため事件の大きな筋をマップ化することが容易であった。
このシステムにおいては、膨大な自白供述の文字データを電子的に格納することが可能であり、その意味で結果の再現性もあると言える。だだし問題点もある。
第一に、本システムによる提示が本当にわかりやすいのか、という点である。この点については、二年目に実証実験を行うべく、認知心理学の知見を活用して、実験計画を構想中である。
第二に、本システムが刑事訴訟法に照らしたとき、証拠の提示といえるのか、それ以上の編集を含むものなのかがわかりにくく、従って、このまま法廷で用いることが可能かどうか分からないという点である。この点については、証拠提示に関する訴訟法的な理論検討を行っていく必要がある。
次年度以降は、こうした問題点も考慮しながらさらなるシステム開発を行い、裁判実務での実装を目指していく。

刑事訴訟法的な検討がやや遅れているとはいえ、メインとなるシステム開発が順調に進んでおり、全体としてはおおむね順調である。

| Strategy for Future Research Activity |
システム開発のために用いることのできる自白供述を手に入れる必要がある。現在行われている事件だけではなく、歴史的なものも視野にいれて、情報収集を心がける。
使いやすさについての実証研究を行う。
