| Research Abstract |
This study set out to find out the structures of the mining laws in early modern and investigate the legal orders in the mining society.
In order to do this I first found out the characteristics of Seirei which should be a fundamental law of the laws and regulations issued to the mines by a feudal clan lord and compared each Seirei. Second, I examined individual laws and regulations issued to each mine, considered in what cases they were issued, and found out how a feudal clan loard ruled the mines from a legal point of view. Third, I considered the laws and regulations legalized inside the mines and found out those characteristics through the comparison with village and town laws concerning the rules of production, life and punishments in the mining society. Fourth, I examined specific examples of the solution of various cases and punishments, and found out the autonomy and self-controlling functions of the mining society concerning the laws and regulations which are not legalized.
