国際組織による国際法の形成・定立機能の実証的研究と国際法定立の現段階

Research Abstract

平成13年には、国際組織による国際法の形成・定立機能に関する研究のうち、国連国際法委員会(International Law Commission ; ILC)が採択した国家責任条文草案に関する前年度の研究成果を踏まえ、国際法形成・定立過程における国連の役割と機能の実態を理論的にまとめる作業を行った。また、前年度に引き続き、国際法協会(International Law Association ; ILA)の「国際組織のアカウンタビリティー」(Accountability of International Organizations)に関する委員会にILA日本支部推薦の委員として加わり、2002年4月にニューデリーで開催予定の国際法協会第70回世界大会に提出するための「国際組織のアカウンタビリティー」に関する報告書の作成作業に参加した。この作業の過程で、2001年12月にロンドン大学(University College London)で開催された同国際委員会に出席した。また、この問題に関しては、2001年3月にオランダのハーグ国際平和宮(Peace Palace)で開催された同委員会に出席した際に、大韓民国・高麗大学の朴基甲教授(Prof.KiーGab PARK)と共同で作成した"Responsibility for Violations of International Law by International Organization" (Working Paper for the ILA's Committee on Accountability of International Organisations)を提出したが、本年度はこの研究成果の一部をさらに発展させた論文"Responsibility of International Organizations and the Role of the International Court of Justice"を完成させ、東北大学の名誉教授であり現在国際司法裁判所(International Court of Justice ; ICJ)の裁判官を務めておられる小田滋裁判官の国際的な記念論文集"Fesyschrift for Judge Shigeru ODA"(ed.by R.Wolfrum, E.McWhinney and N.Ando)に発表した。
