Research Abstract |
The purpose of this study is to examine the "Rivaling Interplay between Globalization and Building of Domestic Legal Infrastructure" and "Comparative Politics of the Process of Regime Changes in Countries in Transition" within the context of "Legal Assistance to Asia". The issue of "Legal Assistance to Asia" emerges as the result of foreign assistance being directed to the building of legal infrastructure in Asian countries which are confronted by the urgent question of transition in their shifting from the socialist system towards a market economy. Since the middle of 1990s, Japanese government has launched assistance projects to help Asian countries in transition promote their legal reforms, with a view of building up legal infrastructures for the process of marketization, in response to the needs of these Asian countries. ding theories of legal transplant, the current situation of building legal infrastructures and the state of legal education, compilation and disclosure of legal information and court precedents, methodologies and assessments applied in legal assistance projects, etc. In conducting these researches, it came to light that there is a need for comprehensive and multi-dimensional discussions on the topics of "Rivaling Interplay between Globalization and Building of Domestic Legal Infrastructure" and "Comparative Politics of the Process of Regime Changes in Countries in Transition", just because these are fundamental questions regulating the framework for legal infrastructure building. However, as these are major topics bridging over all the areas of research mentioned above, they demanded major efforts to be made by all researchers involved in the project to join their findings together in the final reports. Benefited on the results of a series of research group meetings organized in Japan and after numerous academic discussions and dialogues to exchange experiences and research outcomes among researchers of the project, the study has finally come up with two compilations published under the titles of "Legal Assistance in the Process of Globalization" (edited by Saburi Haruo, Obata Kaoru, Kuong Teilee) and "Legal Assistance and Regime Change-A Theory on Comparative Political Systems" respectively.
