Research Abstract |
On 16 December 2002 the Council has adopted the new Regulation No 1/2003 on the implementation of the rules on competition laid down in the Articles 81 and 82 of the EC Treaty. This regulation will put an end to the current notification and exemption system for anticompetitive agreements at European level and replace it by a directly applicable exception system. Together with the abolishment of the Commission's monopoly for issuing exemption decisions and the obligation of national competition authorities and courts to apply European competition law when it is applicable, the new system will have far- reaching effects on companies and their lawyers as well as law enforcers throughout the Community. The Article introduces the new regulation and focuses on the main points of discussion in the Council which have lead to some significant change of the adopted text compared to the initial draft, inter alia regarding the relationship between European and national competition law, the future cooperation between Commission and national competition authorities and the powers for adopting block exemption regulation.
