Outline of Final Research Achievements

Keeping in view the factionalism underling the contemporary society as a whole, this research explores the structure of the "adversarial system" or "adversarial discourse" in general in eighteenth-century England from various perspectives: histories of law, political thought, economic thought, philosophy, and literature.

Academic Significance and Societal Importance of the Research Achievements

伝統的に英米型の刑事裁判の特徴とされる「当事者対抗主義」（adversarial system）の生成・発展は，18世紀のイングランドにおける政治的なレヴェルの党派対立と密接に関連しており，この点は，刑事手続の一種である議会の弾劾手続において，とりわけ顕著に観察される。党派的言説の構造と影響は，法，政治，経済，哲学，文学といった様々な領域に共通して（現代よりもいっそう顕著に）見出されるものであり，同時代の社会全般を分析する際の不可欠の視点であることが確認された。
