本研究は、独占禁止法における企業結合規制の透明性・法的安定性・予見可能性の向上に寄与するものである。事後的検証の実施により、今後の事例において適切な問題解消措置が適切に設計・実行されることを明らかにした。
競争当局が積極的に事後的検証を行っている欧米の状況を整理・検討することにより、競争当局による事後的検証の重要性を明確にした。また、今後の事例において、企業結合を行う当事会社が問題解消措置を設計・実行する際に留意すべき点についても明らかにした。
