Outline of Final Research Achievements

In this research project, we have studied a wide range of legal issues relating to FinTech, including virtual currencies and crypto assets, blockchain technology, smart contracts, cashless payments, artificial intelligence.
Regulatory laws on Fintech have been developed in some areas, such as crypto currencies. However, as far as private laws concern, lots of difficult issues reamin unclear. We have examined various legal issues relating to FinTech in both regulatory and private laws, through on-site researches in foreign countries, analysis of Japanese and foreign articles and dialogues with technology experts. We have published articles about the results of our examination.

Academic Significance and Societal Importance of the Research Achievements

フィンテックへの取組みは、我が国の金融における最重要なテーマの一つである。フィンテックは、監督法・私法の両面で数多くの法的問題を投げかけるが、法的不明確さがフィンテックの発展を不当に阻害してはならない。
本研究は、フィンテックに関して検討すべき法的問題を明らかにするとともに、暗号資産、ブロックチェーン、キャッシュレス決済等の分野において、あるべき考え方等を示すことによって、フィンテックの健全な発展に資することができるような金融法の発展に寄与した。
