Outline of Final Research Achievements |
This study examines the goal and scope of parody defense in Copyright Law. There is no such a defense in Japanese law, but it has already been introduced in many countries' copyright law. This study shows the correspondence of the goal and the form of parody defenses, which cause the variations of them (from European limited exception for parody to US broad exception not just for parody). Finally, this study suggests some legislative options for parody defense in Japanese law, from the perspective of why and how to protect parody in copyright law.

Academic Significance and Societal Importance of the Research Achievements |
本研究の成果としては、学術的には、従来のパロディをめぐる著作権法の議論に対して、近時の欧米での議論を中心に新たな知見を追加できたことが挙げられる。また社会的には、数年前に立法過程において頓挫したパロディ目的の利用に関する権利制限規定について、今後新たに検討する際の指針となり得る提案を提供できたことが挙げられる。
