本研究は、大学や公立図書館などの制度が、学問の自由・表現の自由とどのような関係に立っているのかを理論的に解明した。本研究の意義は、大学や公立図書館が学問の自由・表現の自由の保障にとって重要な役割を演じているということを抽象的あるいは予定調和的に説くのではなく、相互の理論的関係を丁寧に分析したという点に見いだすことができる。本研究の結果、精緻な精神的自由論を構築していくことが可能になった。
