Outline of Final Research Achievements

This study examines the relationship between architecture / urban landscape and intellectual property law, a discussion that has become particularly active since the run-up to the 2020 Tokyo Olympics. Through legal analysis of architecture as (A) creative work (B)real estate (C) form of expression (D)cultural heritage, this research envisions and proposes a new intellectual property law system suitable for our built environment.

Academic Significance and Societal Importance of the Research Achievements

本研究は、建築・都市景観をめぐる法的議論について、知的財産法分野における従来の議論を整理し分析したうえで、知的財産法・所有権法・憲法・文化財保護法など複数の法分野の観点から分野横断的な分析につなげる点において、学術的意義がある。また、この研究により得られる建築・都市景観をめぐる知的財産法制度のあり方についての構想および提言は、市民に受容される環境のあり方に新たな視座を提示する点において、社会的意義がある。
