Outline of Final Research Achievements |
The concepts of "cause" in French law and "causa" in Italian law are related to the enforceability of contract, but they were recently modified or abandoned through the contract law reform or the transition of case law.Those functions of "cause" and "causa" have been replaced by other schemes, such as forms of contracts.The modern contract law are based on the principle of freedom of contract and consensualism, and thus forms of contracts are characterized as pragmatic accessories that are imposed from outside of agreements in order to achieve some goals.

Academic Significance and Societal Importance of the Research Achievements |
本研究は、契約の拘束力を基礎付ける要件としての「原因(コーズ、カウザ)」要件をめぐる近時の法状況について比較法的な分析を展開するものであり、特にイタリア法におけるカウザ論は日本では未だほとんど検討されていないテーマであり、本研究を通じてこの点に関する検討を実施したことには大きな学術的意義が認められる。また、そのような比較法的分析をも踏まえつつ、日本の民法・消費者法における方式・書面要件の意義や機能に関する分析を行ったことは、改正民法における書面要件のあり方を具体的に示した点で重要な社会的意義を担うものであると評価できる。
