| Outline of Final Research Achievements |
In this research project, I clarified many theoretical and practical problems which Japan and other countries face in cases of cross-border insolvency and showed solutions to them.
For instance, I found that cooperation between domestic and foreign courts and cooperation between domestic insolvency representatives and foreign courts are critical to deal with many cases in cross border insolvency, especially those relating to insolvency of group enterprises. In addition, I showed concrete elements which receiving courts should consider in deciding whether recognition of foreign insolvency proceedings or foreign insolvency-related judgments should be against public policy of Japan.

| Academic Significance and Societal Importance of the Research Achievements |
本研究の学術的意義は、2000年に国際倒産モデル法を採択して以降の、国内外の国際倒産の実務を整理し、そこで浮上した諸問題とそれに対する解決策を明らかにした点にある。
社会的意義は、今後も増えていくと思われる国際倒産の事件において、日本の裁判所や実務家が考慮すべき事項、あるいは今後の倒産法の改正等において考慮すべき要素を明らかにすることで、より多くの利害関係人の利益を保護できるような枠組みを提示した点にある。
