迅速性の要請の公的側面及びその結果として被告人も利益を享受することを理由として裁判の迅速化を図ろうとする裁判所と、手続主体として防御権を積極的に行使することを望む被疑者・被告人及びその弁護人が衝突する場面において、精密司法的な実務であることを前提とし、当事者主義を採用する日本の刑事訴訟を被告人の主体性を保障する公正な手続とするために、正当・公正な手続の要請との関係から、刑事手続における迅速性の要請の現代的意義を再考する。
