| Research Abstract |
ADR設置主体となる各士業団対応における法制定前後の見解の変化等についての資料とインタビュー調査による検証、北米型ADR運用モデルの導入のあり方の検証、比較対象として、海外のADR法制と現況の調査を、それぞれ実施し、それを通して、(1) ADR運用プラクティスの構築にみる法の浸透と変容、(2) 北米モデルの異なる文化的・法環境的背景のもとでの浸透と変容、(3) 構築されたADRプラクティスの我が国における実践的有効性を明らかにする。
