Research Abstract	本研究では、明示の根拠規定を欠く国際司法裁判所の裁量行為を基礎付ける「固有の権限」について考察した。関連する判例の分析から、「固有の権限」は、裁量行為に対する一貫した規律をもたらす基盤を欠いており裁判所の恣意による濫用の傾向を示しつつも、訴訟の発展性と安定性の均衡を図りながら紛争の解決を目指す国際司法裁判所の柔軟な司法政策を法的に正当化する理論として援用されていることを実証的に明らかにした。
