Research Abstract	本研究の結果として,民事訴訟の手続の構造と裁判官との役割との関係について,(1)近代ドイツ法及び日本法のように著しく一元的な手続構造の下では,手続内における裁判官の影響力は極めて大きなものとならざるを得ないこと,また,(2)現在の日本の手続構造の下では,原告・被告の地位決定を内容とする事前手続が存在しないことが,手続における裁判官の役割をめぐる議論に影響を与えていること,を明らかにすることができた.
