Outline of Final Research Achievements

Through this study I tried to clarify the philosophical logic for building a bridge between the universal human rights and the citizenship rights. According to the standard understanding, human rights are regarded to be enjoyed by every human person without any conditions or restrictions on the one hand. In contrast to this, citizenship rights are applied only to the citizens of particular political community like a national state, on the other hand. But when we look closely at the historical development of human rights and citizenship rights, we can find out that there were always struggles around the recognition both of new subjects of rights and of new rights. Such a basic logic of struggle around the mutual recognition was founded by J.G.Fichte and G.W.F.Hegel in particular in the history of western philosophy. This study has tried to develop the insights of these two philosophers to build the theoretical connection between human rights and citizenship rights.

本研究は、法学においても哲学においてもその妥当根拠が依然として曖昧である人権の論理的な基盤を明らかにすることに貢献するものである。本研究はまたそのことをとおして、通常の理解にしたがえば特定の政治的共同体の成員資格を意味するとみなされがちなシティズンシップを、普遍主義的な人権の理念へ架橋していくための理路を明らかにする。そうすることによって、シティズンシップはもはや、個別主義的で静態的なシティズンシップの固定観念を越えて、21世紀においても欧州シティズンシップとして具体化されつつあるトランスナショナルなシティズンシップの構想を語ることができるようになる。
