Outline of Final Research Achievements |
In this study, I investigated criminal regulations against privacy infringement by taking and spreading images in comparison with German criminal law. I found the following. In Japan, although there are criminal regulations by ordinances and Minor Offenses Act, they are only fragmentary. On the other hand, in Germany, Article 201a of the Penal Code, which punishes voyeurism in private spaces, is in operation, and in 2020, Article 184k, which punishes voyeurism in public spaces, was added. I conclude that further investigation of such German criminal regulations may provide useful new knowledge in thinking about what Japanese criminal regulations should be.

Academic Significance and Societal Importance of the Research Achievements |
盗撮は、プライバシーその他の権利を侵害する違法な行為であるが、それが犯罪として処罰されるのは一部のものに限られている。本研究では、スマートフォンやインターネットが発達した現在、そのような断片的な刑事規制で足りるかどうかを、ドイツにおける盗撮等の刑事規制と比較しながら検討した。本研究は、盗撮等の刑事規制のあり方を考える際の基礎資料となるものであり、この点に学術的・社会的意義がある。
