Outline of Final Research Achievements |
From the plan of the Road Map of government for the highly automated Driving, which shows, that the highly automated driving in highway and automatic driving with level 4 in the limited areas will be realized, this research puts its focus on the reform of road traffic Law in Japan and Germany, product liability insurance for automated navigation system, and problems of reimbursement. In this research, it was concretely made clear, the category of driver's negligence during automated driving, which is requirements for the property liability insurance, way of being of reimbursement as the results of comparative law between in Germany and in Japan, and the strict liability for manufactures of automatic navigation system for Level 4.

Academic Significance and Societal Importance of the Research Achievements |
本研究成果は、自動運転レベル3の高度自動運転に対応した自動車保険の対物賠償責任の前提となる運転者の過失類型、限定地域におけるレベル4の無人自動運転のための自動運行装置の製造者責任の厳格化と最適な保険制度の構築、効率的な求償の在り方について、ドイツ法との比較法研究の成果に基づく新たな観点を明らかにしたことによって、高度自動運転の民事責任と保険にかかる学術的発展に寄与したといえる。 本研究の社会的意義は、高度自動運転に対応した複数の事業者との協力型保険の有用性を示したことにあるといえる。
