倒産裁判所と手続機関との「協働」に注目しつつ、倒産処理におけるガバナンスのあり方の動態的な分析を企図する本課題は、研究代表者が一貫して取り組んできた独自の理論研究であり、最終的な到達目標をなす倒産処理ガバナンス理論の構築とともに、倒産法分野の薄い理論研究に独創性のある厚みを加えるという学術的意義があるだけでなく、現実の課題に対処する分析視角を提示する実践に資する理論として、とりわけコロナ後に極めて困難な経済・社会状態の到来が見込まれるなか、重要な社会的意義がある。
