Outline of Final Research Achievements

In this study, we conducted a literature review focusing on legislative trends in Germany regarding children’s rights because for the pandemic we were unable to conduct interview directly with German practicians. In Germany laws that claim to improve and strengthen “children’s rights” have been enacted several times since the 2000s. I translated main laws of those and examined their legislative process.

Academic Significance and Societal Importance of the Research Achievements

本課題では、第1に2021年に大改正を受けた社会法典第８編の全訳を行った。私は平成17―18年度科研費研究として同法典の全訳（共訳）を行い、研究成果報告書としてまとめているが、この度は同訳を基礎として新たに作業を行ったものである。また第２には、一部改正があった連邦児童保護法の全訳、第３に基本法に子どもの権利に関する規定を置くための「基本法改正に関する連邦政府草案」及びその基礎となった連邦＝州＝作業グループの「基本法における子どもの権利」最終報告書の全訳を行った。これらの訳出作業はいずれも他では行われておらず、その意義は高い。これらについてはすでに一部資料集としてまとめられ、公表されている。
