Outline of Final Research Achievements

I conducted comprehensive research on how to utilize the remedies for intellectual property infringement as the norms that facilitate negotiations between the parties. By this study, I clarified that a unified understanding should be　maintained in the calculation of damages while considering the characteristics of patents and copyrights. I also considered the remedies for cross-border intellectual property infringement.

Academic Significance and Societal Importance of the Research Achievements

本研究により、特許法や著作権法などそれぞれの知的財産法分野の特性を踏まえつつ、侵害抑止と相手方の行為自由の保障・填補賠償の原則とが調和した救済制度のあり方を明らかにすることができた。これにより、差止めや損害賠償など救済制度をどのように運用することが当事者間の紛争解決に資するかという大きな課題に道筋をつけることができた点が、本研究の意義である。
