| Research Abstract |
本研究は、国際法における個人責任原則の実際的な機能を、法適用過程と法調整過程という二つのモデルを立てながら、種々の国際刑事裁判機構の設立文書・判例、個人賠償に関する国際文書などの分析を通して解明することを目的とした。国際法の個人に対する直接的な適用に基礎をおく個人責任原則が、国内法秩序との関係で複雑な問題を惹起させる点に着目し、これが現実に処理されている過程を実証的に検討し、その特質を明らかにした。
