| Research Abstract |
私生活・家族生活の尊重を定めるヨーロッパ人権条約8条と、婚姻をし、家族を形成する権利を定める同条約12条に着目し、これらの条文における「家族」の意味は何かを検討することを目指した。その際、ヨーロッパ人権条約が、フランス国内の家族法における理論的・実務的影響も視野に入れて検討を行った。
