Outline of Final Research Achievements

This research project tried, first, to elucidate the actual state of “judicial dialogue” in Europe, of which sufficient empirical research has yet to be conducted. Second, this study on “judicial dialogue” also took Asia including Japan into consideration. Third, we examined also the theoretical problems of “judicial dialogue” in international law and EU law because they have not been tackled in legal litteratures.

Academic Significance and Societal Importance of the Research Achievements

ヨーロッパにおいて近年極めて重要な現象として注目されている「裁判官対話(dialogue des juges)」につき，(1)その歴史的展開過程とその背景・動因，(2)その国際法・EU法上の理論的問題を検討するとともに，(3)そのような現象が従来殆ど知られていなかった東アジアにおける萌芽的動向を見いだし，グローバル化の中での日本司法のガラパゴス化の危険に警鐘を鳴らした点に学術的・社会的意義がある．
