Outline of Final Research Achievements

This study started with an observation that the Japanese judicial review system needs to develop constitutional remedies. I conducted a detailed analysis of the Supreme Court’s constitutional decisions and published several articles, including some case studies and some analyses of the general theory of constitutional remedies.

Academic Significance and Societal Importance of the Research Achievements

現在の裁判所は以前に比べると違憲審査権を積極的に行使するようになっているが、その背景には、憲法判断の方法に関する工夫があると思われる。ただ、それでもなお、適切な判断方法がないとして憲法判断に踏み切れない事例や、憲法判断に踏み切ったものの予想外の結果が生じている事例はあるように思われる。憲法判断の方法については優れた先行業績があるが、本研究は、それをさらに発展させることを試みた。結果、投票価値訴訟など一定の分野や違憲判決の効力などいくつかの論点に関しては成果を得ることができ、また、今後の研究の方向性についても視点を得ることができた。
