Outline of Final Research Achievements |
The purpose of this research is to clarify who can and cannot be held criminally liable in various accident cases concerning automated vehicles.I set and analyzed various accident case examples considering levels of automation, operation modes and accident situations, and based on these analyses, I organized legal issues from a theoretical and practical point of view. As a theoretical problem, I discussed the concerns of both underpunishment and overpunishment in determining negligence and pointed out the importance of safety regulations.As a practical problem, I pointed out that investigations and trials will become more specialized, complicated, and internationalized and discussed the need for coordination between administrative and criminal procedures and the need to review how individual and corporate punishments should be dealt with.

Academic Significance and Societal Importance of the Research Achievements |
本研究成果の意義は、主に以下の2点である。 第1に、2021年にレベル3の自動運転車が認可され、2023年にレベル4の自動運転車移動サービスの運行が許可され、自動運転車の社会実装が始まって法整備が進みつつある段階で、自動運転という最先端の技術に関する未解決の法的課題に取り組み、現状の問題を指摘し、今後の課題を提示したところに本研究成果の意義がある。 第2に、過失に関する理論的観点と、証拠の収集・分析及び事実認定という実務的観点の双方から問題を整理し、それぞれの観点から今後の課題を示したところに本研究成果の意義がある。
