Outline of Final Research Achievements

Significance of this study lies in the analysis of the "modernization of inheritance law" directed by the series of revised laws since 2018. The analysis is based on the following perspectives, namely, the protection of surviving spouses, the legal evaluation of contribution to the decedent by the relatives, the impact of conversion of the right of legally reserved portion into a monetary claim to the testator's final intention, and the diversification of options in the inheritance rights of legal heirs, including the management and disposition of the estate. Furthermore, this study aims at clarification of the evolution of the concept of modern inheritance law and the possibility of inheritance legislation as a basis for the private property system, by using German law and laws of the United States.
These analyses contribute to responding to the change of the society and to esteeming the inheritance legal system as the order of the property ownership.

Academic Significance and Societal Importance of the Research Achievements

法定相続制度と遺言・遺留分制度が相続法規範として一体的に実現する被相続人の意思と法益の連続性という観点から、法的安定性と妥当性を備えた死者の財産の承継という相続法の制度設計を支える「現代社会における相続法制の法理」を解析する点に、本研究の学術的・社会的意義がある。これによって、相続人ら被相続人の死亡により財産を承継する者の権利・法益と被相続人自身の権利・法益という「人」の観点からの複眼的検討、及び、相続財産の経済的価値、相続法的評価及び社会的認識という「財産」の観点からの多角的分析が可能となり、現代における相続法規範のグランド・デザインの提示に繋がる。
