Outline of Annual Research Achievements |
The research has so far produced two working papers which have examined the role of the courts in two of the targeted countries, Canada and Japan. The Canadian data indicate that claims using the oppression remedy have come to dominate in recent years, with cases involving contract law disputes and in bankruptcy proceedings also being prominent. With respect to Japan the research has found that disputes over director pay have become quite common over the past twenty years and that, surprisingly, directors themselves drive most of this. Preliminary Japanese results were presented at the Japan Studies Association of Canada conference in October, 2020, and in a Euraxess Japan webinar, both of which were online due to the pandemic.

2: Research has progressed on the whole more than it was originally planned.
Reason
The working paper on Canadian cases has been accepted for publication at a leading journal, and work on it is basically complete.
The author has released the working paper on Japan via SSRN, but is currently working on revising the paper based on comments received from colleagues in preparation to submit it for publication later this year.

Strategy for Future Research Activity |
The author is scheduled to present the Canadian results at the Law and Development Institute's Conference in November, 2021. In addition to that and completing the paper on Japan, the next phase of research will simply involve moving on to the remaining jurisdictions. The empirical research (gathering the judicial decisions themselves) has not yet begun for these jurisdictions and that will be the next major task, which will begin after the afore mentioned completion of the current works is done.

Causes of Carryover |
My main expense this year will be a conference presentation in Germany in November, 2021. This of course is dependent on the Covid 19 situation.
Additionally there will be some small expenditures on minor articles necessary for the research.
