Outline of Final Research Achievements

In this study, we have examined the legal foundations of the transportation system required by the next generation. With reference to the recent transport reform theory in Germany, we have envisioned a new legal framework for the generation of transport funds and the redistribution of transport space, and have proposed a reconfiguration of the Public Property Law and the Public Enterprise Law. Through this study, we believe that we have established a theoretical foundation for a sustainable transportation legal system.

Academic Significance and Societal Importance of the Research Achievements

本研究は、交通法制を主として支えてきた公物法および公企業法の再構成を図り、その持続可能な理論上の裏付けを確保しながら、交通に対する国家および行政の在り方を示したところに、その学術的な意義を有する。気候変動や人口減少社会の到来を背景に、環境にやさしい交通手段への転換、交通インフラの維持、いわゆるコンパクトシティの実現に向けた試行錯誤が図られているが、こうした政策を具体的に進めるためには、交通財源の在り方を見直したり、交通空間を再配分したりする必要があり、本研究は、その法的な基盤を確立するところに貢献しており、研究成果の社会的意義を認めることができよう。
