Outline of Final Research Achievements |
In Japan, security deposits are like loans from the tenant to the landlord. However, tenants sometimes cannot recover their security deposits, when their landlords declare bankruptcy. This research concludes, by analyzing the U. S. law, security deposits should be characterized as security collateral. Such characterization would be necessary for the protection of the right of tenants.

Academic Significance and Societal Importance of the Research Achievements |
日本法の敷金は,その法律構成において,賃借人が賃貸人に対して貸付を行っている実態にあり,また,返還手続等において,当事者の合意に委ねたものとなっている。これは,アメリカ法の最初期の状況に対置される。 アメリカ法の展開からは,そうした日本法の状況が賃貸人と賃借人との間で不公平な状況を生じていることが示唆される。本研究は,敷金を金銭に対する担保権として法律構成をすることにより,そうした課題を解決することを試みている。
