Research Abstract |
Collective redress actions for the purpose of consumer protection that have already come into force as national legislation in North American, South American and European countries can be categorized in 4 types, namely, opt-in type, opt-out type, combined type and two-step type. In accordance with our analysis, each type has advantages and disadvantages and each type has different consistency with Japanese legal system in existence. Therefore, the legislative design in Japan must consider these factors.
