Outline of Final Research Achievements

I studied the position of inheritance creditors. I can say that the bigger control the testator has, the more power the creditor could have over the property and interest concerned.

Academic Significance and Societal Importance of the Research Achievements

被相続人の債権者が、被相続人が生前行っていた死因処分の目的財産や、その財産に由来する利益に対して、どのような権利行使をすることができるのか（できないのか）ということを明確にしておく要請は大きい。本研究は、死因処分の行為者が死因処分の目的財産等に対して有するコントロールの大小と、相続債権者の当該目的財産等に対する権利行使の可否とが対応することを明らかにしたものである。これによって、相続という誰もに生じる、あるいは、誰もが関係しうる事柄において、関係当事者の地位をめぐる民事法的な規律の一端が明らかになり、その社会的意義は大きいものであると考える。
