Outline of Final Research Achievements |
We examined the precedents and theories regarding subpoena, which is a pull-type administrative investigation, and compared it with the control doctrine for push-type administrative investigations.The legal control over subpoena in the United States is similar to that for criminal investigations. We have clarified the theoretical basis of legal control, which imposes only slight restrictions compared to push-type administrative investigations. Specifically, subpoena (1) historically derives from the investigative authority of a grand jury and has a different historical background from push-type administrative investigations, and (2) the degree of privacy infringement that occurs is minor. The latter argument provides useful suggestions for Japan.

Academic Significance and Societal Importance of the Research Achievements |
多くの議論蓄積がある刑事捜査においては主としてプッシュ型の捜査活動が行われているため,プッシュ型の行政調査については刑事捜査の法的統制を参考に法的統制枠組みを構築することは比較的容易であるが,一方でプル型の調査については刑事捜査との距離は遠く検討はより困難であった。このような状況において、プル型の調査にもプッシュ型の調査活動に対する法的統制がどの程度及ぶかを明らかにした本研究は、我が国の行政調査のあるべき統制法理を考察する上で重要な指摘を行うものである。
