Outline of Final Research Achievements |
This research examines procedural safeguards for the detention, treatment, and interrogation of vulnerable suspects in custody. It is thought that some suspects in custody are likely to make a false confession for their mental disabilities and other psychological problems. Some commentators point out that the 2016 amendments of the Code of Criminal Procedure’s safeguards are insufficient to eliminate the risk of such false confessions by those suspects. Therefore, this research, compared with British law, explores: (1) Which safeguards are needed to guarantee the reliability of statements by vulnerable suspects and (2) evidence rules to ensure that those safeguards effectively work.

Academic Significance and Societal Importance of the Research Achievements |
本研究は、「取調べの可視化」という観点から積み重ねられてきた従来の議論に加え、イギリスとの比較検討から、精神障害・知的障害を有する被疑者の特性という虚偽自白が行われる別の誘因に着目して身柄拘束下の取調べにおける保護策を考察する点で学術的な意義が認められる。又、身柄拘束下の取調べの規律に関しては議論が未だ盛んに行われているところ、本研究は今後の法整備における一定の指針を示した点で社会的な意義を有する。
