Outline of Final Research Achievements |
In this study, I focused on the parliamentary factions, which are considered as one of the legal entities in a parliamentary cabinet system, and examined whether it is possible to grasp them constitutionally, and if so, what legal characteristics they possess, using a comparative legal approach. In doing so, I referred to the discussions surrounding the legal status of parliamentary factions in Germany, where a parliamentary cabinet system, similar to Japan, has been adopted and where numerous research outcomes regarding factions have been accumulated. As a result of this study, it has been revealed that in contemporary German constitutional studies, there is a groundbreaking theory (by Sven Hoelscheidt), which is widely supported, and according to this theory, factions can be understood as diverged entities of the parliament (distinct from the committees that serve as subordinate bodies of the parliament) based on the constitution.

Academic Significance and Societal Importance of the Research Achievements |
本研究の成果の学術的意義は、会派の法的地位を論証する場合に、①会派が憲法上どのように根拠づけられるのかを問題にする議論(憲法的基礎づけ論)、②会派がどのような法的性格を有するのかを問題にする議論(法的性質の確定論)の順にそれを説き起こし得ることを比較法的に明らかにした点にある。 本研究の成果の社会的意義は、国会の中で会派が議事運営・諸活動の基本単位になっており(いわゆる「会派議会」)、会派を抜きにして国会の運営を考えることはできないと言われているわが国の国会実務の現状において、そのような会派を日本国憲法に基づいて把握するための解釈理論を明らかにした点にある。
