Outline of Final Research Achievements |
This study reconstructed the theory of causal complicity, the commonly accepted theory of the grounds for punishment of complicity, and developed a theoretical foundation for solving various problems in the theory of complicity regarding special fraud. In addition, as a solution to specific problems, this study provided some guidelines for solving the problems of successor-in-crime and comprehensive conspiracy, which were difficult to explain with the conventional theory of causal complicity.

Academic Significance and Societal Importance of the Research Achievements |
本研究は、共同正犯の成立を基礎づける「共謀」の理解について、従来の理解とは異なる新たな理解を示した。本研究で示した理解は、従来の理解よりも、共同正犯と狭義の共犯(教唆犯及び幇助犯)の違いをよりよく説明することができ、それにより、両者の区別をより容易なものとすることができる。また、そのような理解は、特殊詐欺事件等において生じる共犯論上の諸問題に対しても、一定の解決指針を提供することができる。そのため、本研究で得られた成果は、実践的な意義も有する。
