| Research Abstract |
This study shows the basis of the Fair Use doctrine in the case of secondary copyright infringement from a viewpoint of innovation and cultural policy. This opinion is based on the analysis of the cases of businesses and Book Search Project by Search Engine, Service provider, devices for private copy in comparative law, economics and history, The analysis of the cases in patent indirect infringement reveals the same problems by the development of software and internet. Therese analysis reflects the perspective of the change from property through tort to positive externality by restriction of copyright.
