Research Abstract |
Institutional design of EEA was regarded as "a mission impossible" because of its contradictory obejctives: ensuring "homogeneity" between EFTA pillar and EC pillar without transfering legislative powers of EFTA States to the EEA institutions. Contrary to discouraging prediction by Community lawyers in its early years, the EEA is now said to have achieved almost the same result as in EC law in terms of judicial protection of individual rights. This finding suggests that EC law is not necessarily the sole model for economic integration and shows the importance of judicial dialogue between international and national courts in Europe.
